Negotiation, Consensus and Productive Disagreement | 协商、共识与建设性分歧
Good negotiation is not winning every point. It is discovering where interests, evidence, definitions and constraints actually align—and where they do not.
At advanced levels, disagreement often continues even when everyone is intelligent, informed and acting in good faith. Language must therefore do more than persuade. It must clarify interests, separate factual from value disputes, identify trade-offs, protect relationships and make partial agreement visible.

1. Position | 立场
A position is what someone says they want.
We need Option A.
2. Interest | 利益/关切
An interest is why that position matters.
We need predictable delivery times.
3. Position ≠ interest | 立场不等于真正需求
Two people may hold opposing positions while sharing the same underlying interest.
4. Ask why without sounding accusatory | 询问原因但不攻击
- What matters most about that option?
- Which problem are you trying to solve?
- What would make an alternative acceptable?
5. Constraint | 约束
A constraint is something that limits the solution space.
- budget
- time
- law
- safety
- staffing
6. Preference vs constraint | 偏好 vs 约束
We prefer Friday is different from Friday is the legal deadline.
7. Mandatory vs negotiable | 必须 vs 可谈
Make clear which requirements cannot move.
8. Shared goal | 共同目标
Start by identifying what both sides want.
We both want a system that is reliable enough to use at scale.
9. Shared facts | 共同事实
Separate what everyone accepts from what remains disputed.
10. Shared definitions | 共同定义
Use Lesson 093 discipline:
When we say “reliable”, do we mean uptime, recovery time, or consistency of output?
11. Shared criteria | 共同判据
Agreement on criteria can make later disagreement easier to manage.
12. Weighting dispute | 权重分歧
Both sides may accept the same criteria but give them different importance.
13. Make weighting explicit | 把权重说清楚
It sounds as though you place more weight on speed, while I place more weight on reliability.
14. Factual disagreement | 事实分歧
Resolve with evidence where possible.
15. Method disagreement | 方法分歧
Resolve by comparing how evidence was produced.
16. Value disagreement | 价值分歧
May not be resolvable by more data alone.
17. Do not use evidence to hide a value dispute | 不要用数据掩盖价值分歧
If the real question is fairness vs efficiency, say so.

Consensus does not need to cover every issue.
22. Layered consensus | 分层共识

24. Conditional proposal | 条件提案
We could proceed with Option B if error rate remains below 2%.
25. Trade-off language | 取舍语言
- This improves speed at the cost of…
- The main trade-off is…
- We gain X but lose Y.
26. Concession | 让步
A concession is something one side gives up.
27. Concession should be explicit | 让步要明确
We can accept the higher cost if the reliability guarantee is strengthened.
28. Reciprocal movement | 双方移动
Negotiation becomes unstable when only one side makes concessions.
29. Package proposals | 组合提案
Instead of bargaining one issue at a time, combine several:
- price
- timing
- support
- quality
30. Package allows trade | 组合让交换更容易
One side may care more about time; the other about cost.
31. Clarifying proposal meaning | 澄清提案
- Do you mean X is guaranteed?
- Is that condition mandatory?
- What happens if the threshold is missed?

It also gives the other side a chance to correct your interpretation.
34. Steelman the other side | 公平重述对方最强观点
If I understand you correctly, your strongest concern is not price itself but the unpredictability of future cost.

Is that a fair summary?
36. Productive disagreement | 建设性分歧
Disagreement is productive when it improves definitions, evidence, options or decisions.
37. Unproductive disagreement | 无效分歧

38. Motive claims | 动机推断
Do not infer bad faith without evidence.
39. Separate person from proposition | 人与主张分开

- Let’s separate two issues.

We may need more information before deciding this point.
43. No-deal can be rational | 不达成协议也可能合理
Consensus should not be forced when standards cannot be met.

45. Consensus vs unanimity | 共识 vs 全体一致
Consensus may mean sufficient shared support to proceed, depending on context. Unanimity means everyone agrees.

Do not assume everyone uses the word identically.
47. Majority decision | 多数决策
Voting is one decision rule, not the same as consensus.
48. Expert recommendation | 专家建议
An expert may recommend while decision authority remains elsewhere.

A mediator helps clarify positions, interests and misunderstandings without deciding the substantive outcome.
